Summary of Opinions on Relationship Between Human Rights and Social Development and Stability

The development of human society is a process of pursuing human rights. Human rights develop with social development.

Human rights develop from primary to higher level period. This is the universatity of human rights development. And yet, there are differences in the extent and form of human rights development in different places and in different countries, even in the same period of time, because of historical, cultural, economic and social structural differences.

Social stability any development is the pre-condition for improving human rights. Only by correctly acknowledging the relationship between human rights and stable social development can the former's development be effectively promoted.

1. Development of Human Rights Goes along with the Human Social Development from Primary to Higher Level Period

Human rights should be enjoyed by those who are supported with certain morality, ideal and values. The natural and social quality of mankind originated and motivated the emerge and the development of human rights. The contents and form of human rights, instead of being static, develop from primary to higher level period along with human society without stop.

Early in the ancient, primitive tribes divided territories and seldom confronted each other so as to ensure their own survival and multiplication. Within a tribe, people enjoyed the achievements of their labor together. When there was any intruders, they either drove them away or caught and ate them. They knew that the survival of their group could ensure their individual survival. That was the primitive illustration of people's right of survival. It was the most primitive and basic human rights consciousness.

Different from other animals, mankind coultivated ability of thinking through labor. Human beings can acknowledge and reform their living environment. The existence of this ability and the pursuit of a happy and good life propel society to develop from a primary to an advanced stage. The contents of the rights that people can and should enjoy also develop in the same way.

In history, no matter it was the uprising for the right of survival in the Roman Imperial Kingdom, or the religious reform for religious freedom in Europe in the 16th century, and the US principle of "everyone is born equal, and enoys the rights of life, freedom and pursuit of happiness" in the Declaration of Independence published in 1776, of the principle of "amone all races, sexes, languages and religions, respect for human rights and basic freedom for mankind must be promoted and encouraged" in the Universal Declaration of Human Rights in 1948, the human rights development of the world runs through the development of human society, and follows a routine of advancement from a primary to an advanced stage and from simplicity to complexity.

Different histories and cultures have produced rich and colorful theories of human rights. The emerge and development of human rights theory accelerate the practice of human rights development. People's desire for self-perfection and better life is boundless. The social development is also boundless. The same, the development of human rights will never stop.

2. Development of Human Rights Complies with Social Development

human rights are not isolated, but compromise all aspects of human material and spirtual life. Also, human rights are not abstract. They reflect the actual rights and profits that people can enjoy in productive relations in the slavery society. Compared with slavery society, the greatest changes in human rights conditions in the feudal society was that farmers got limited freedom. But they would loose this freedom if they did not depend on landlords, renting landlords' fields and handing it most of their produce to the landlords according to contracts. This situation of human rights came from the way of social production during the feudal times.

Development of industries and commerce gradually made newly-arising capitalists representatives of productivty. To gain and maintain the rights they should enjoy, these capitalists carried out long-term struggle with feudal landlords. In Britain, from the Rights Application Charlie I was forced to sign in 1628 to the Great Written Protest passed to the king and was passed by the congress in 1641, and to the first capitalist human rights law Draft of Rights passed by the parliament in 1689, 61 years had passed. In 1789, the French parliament passed the Declaration of Human Rights and civil Rights, defining "natural, inalienable and holy human rights" and stressing innate rights of mankind, which refer to "freedom, property, safety and resistance against oppression," "all citizens are equal in front of law," and "property is holy, inviolable right."

Socialist society is a new period in the history of human rights development. New production relations made the working class masters of the society. Under the principle of "distributing according to one's work," everyone was equal. In China, the laws passed at the national people's congress grarantee that every citizen enjoys all rights equally. The rise and development of socialist countries have exerted positive influences upon modern industrial countries and have also improved the human rights situation to a large extent.

After the World War II, with the development of national liberalization movement against colonialist, new characteristics occurred in human rights development-international collective rights such as national rights for self-decision making, development, peace, natural resources, environment and humanitarian aids. The Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights of the United Nations are important documents illustrating basic human rights.

3. Diversification of Social Development Had Decided the Diversification of Human Rights, Which Means that There Are Different Characteristics of Human Rights in Different Countries

because of differences in political systems, economic development levels, historical and cultural traditions, religions beliefs, people's education levels and moral values, the contents and forms of human rights are definitely different in different countries, in different areas in a country, or in one country at different times in history.

Economic development level exerts decisive influences upon the actual rights that people can enjoy. When rich and developed countries are thinking about how to solve the problem in environment protection in order to live a better life, some poor developing countries have to face the problems such as how to develop economy in order to feed their people and satisfy their other basic material demands.

Traditional culture also exerts significant influences upon human values and illustration of human rights. Eastern cultures, especially the Confucianist culture represented by the Confucius, stress "the benevolent loves for others," "don't make others do what you don't want to do" and "be kind to others." In social practices, these principles are shown as spirit of collectiveness, maintaining the rights and interests of the collective and sacrificing one's own inter ests for sake of the national and collective interests. The touching stories during the flood-resistance efforts the summer exactly illustrate values of the Chinese people. However, in Europe and America, individualism is stressed in culture. Attention is paid to individual development as well as individual rights and interests.

Religious freedom is a significant part of human rights protection. Since there are different doctrines, contents and forms of beliefs, religions exert different influences upon people who hold different religious beliefs. It is especially so in countries which combines politics with religions. Differences in religious beliefs have induced several big wars in history.

Modern political powers are also illustrated it different forms in different countries. Though, the United States, France and Russia carry a system of president and parliament, the structure and activities of the US parliament is different from those of the French parliament, and the power of the Russian president is greater than thar of the US president. Some countries still have kings and queens. But obviously, the power that the Saudi Arabian king can enjoy is different from that the British queen can. China's people's congress and political consultaive conference system is different from foreign parliaments. The differences of political power organizations stem from different national conditions. Each nation has its own right to choose a model suitable for its own. This is also illustration of human rights.

The diversity of human rights developmdnt and the different characteristics of human right in difference countries exist objectively, and do not change because other countries like or dislike them. The international community should pay regard to this fact.

4. Social Stability Is a Significant Condition Which Guarantees the Development of Human Rights

only when the overall situation is stable and people live in peace can everything be on rise. Only a stable society can ensure the sustained development of productivity, maintain human security, achieve economic increase, scientific and technological progress, cultural prosperity and legislative perfection, and promote.
