China Ratifies the Treaty between China and Namibia on Criminal Judicial Assistance

It was decided by voting at the fourth session of the Standing Committee of the 11th National People’s Congress on August 29 2008 that the Treaty between the People's Republic of China and the Republic of Namibia on Criminal Judicial Assistance was ratified.

While testifying to the fourth session of the Standing Committee of the 11th National People’s Congress, Vice Foreign Minister He Yafei said that as the political, economic and trade relations between China and Namibia move forward, the two countries also started to carry out judicial cooperation. To further strengthen judicial cooperation between the two countries and combat transnational crimes, the two countries deemed it necessary to enter into a treaty on criminal judicial assistance. In March 2006, the two countries initiated negotiations on entering into such a treaty and reached consensus on all the articles and clauses of the treaty. In May 2006, Chinese Minister of Justice Wu Aiying and Namibian Minister of Justice signed the treaty on behalf of their countries.

The Treaty between China and Namibia on Criminal Judicial Assistance contains 24 articles, mainly covering the scope of application, means of contact for judicial assistance, reasons for refusing or deferring judicial assistance, contents and forms of the request for judicial assistance, ways and rules for executing the request, exchange of legal documents, and dispute settlement.

It is said that the articles and clauses of the treaty accord with basic principles and judicial practices of China’s legal system and are in line with the interest and actual needs of China. The ratification and entry into force of the treaty will promote the judicial cooperation between the two countries and advance the friendly cooperative relationship between the two countries.
