Regulations of the People's Republic of China on

Administration of Arms Export

(Promulgated by Decree No. 234 of the State Council of the People's Republic of China and the Central Military Commission of the People's Republic of China on October 22, 1997, and revised in accordance with the Decision of the State Council and the Central Military Commission on Amending the Regulations of the People's Republic of China on Administration of Arms Export on October 15, 2002)

Chapter I General Provisions

Article 1 These Regulations are formulated for the purposes of strengthening the unified administration of arms export and maintaining the normal order of arms export.

Article 2 "Arms export" referred to in these Regulations means the export for trade of equipment, special production facilities and other materials, technology and related services which are used for military purposes.

Arms export referred to in the preceding paragraph shall be included in the arms export administration list. The arms export administration list shall be formulated, adjusted and published by the competent arms export department of the State.

Article 3 The competent arms export department of the State shall, under the leadership of the State Council and the Central Military Commission, take charge of the arms export work throughout the country and exercise supervision and administration of arms export throughout the country.

Article 4 The State shall institute a unified administration system for the export of arms, forbid any act of exporting arms which endangers the interests and security of the State and maintain the normal order of arms export according to law.

Article 5 The following principles shall be observed in exporting arms:

(1) conduciveness to the capability for just self-defence of the recipient country;

(2) no injury to the peace, security and stability of the region concerned and the world as a whole;

(3) no interference in the internal affairs of the recipient country.

Article 6 Where an international treaty concluded or acceded to by the People's Republic of China contains provisions different from these Regulations, the provisions of the international treaty shall prevail, except for the provisions on which reservations are made by the People's Republic of China.

Chapter II Arms Trading Companies

Article 7 "An arms trading company" referred to in these Regulations means a legal person enterprise which has obtained according to law the business operations right for arms export and is engaged in arms export business activities within the approved scope of business.

Article 8 The business operations right for arms export shall be examined and approved by the competent arms export department of the State. Specific measures shall be formulated by the competent arms export department of the State.

Article 9 An arms trading company shall enjoy full autonomy in its management and assume sole responsibility for its profits or losses according to law.

Article 10 An arms trading company shall honour contracts, guarantee the quality of goods and improve post-sale services.

Article 11 In accordance with the provisions of the competent arms export department of the State, an arms trading company shall truthfully present the documents and data pertinent to its arms export business activities. The competent arms export department of the State shall keep business secrets of the arms trading company and protect its lawful rights and interests.

Article 12 An arms trading company may entrust an approved transportation enterprise for arms export with the transportation of arms for export and related business matters. Specific measures shall be formulated by the competent arms export department of the State.

Chapter III Administration of Arms Export

Article 13 The State shall implement a licencing system for arms export.

Proposals and contracts for arms export shall be submitted in form of application for examination and approval in accordance with the provisions of these Regulations. Arms shall be exported on the basis of a licence for arms export.

Article 14 Proposals for arms export shall be examined and approved by the competent arms export department of the State, or by the competent arms export department of the State jointly with the relevant departments of the State Council and the Central Military Commission.

Article 15 When proposals for arms export are approved, an arms trading company may conclude contracts for arms export with the foreign side. After a contract for arms export is concluded, it shall file an application with the competent arms export department of the State for examination and approval; the competent arms export department of the State shall make a decision thereon within 20 days from the date of receipt of the application. A contract for arms export shall become effective only after it is approved.

When filing an application with the competent arms export department of the State for approval of its contract for arms export, an arms trading company shall attach the valid certification documents of the recipient country.

Article 16 Important proposals and contracts for arms export shall be examined by the competent arms export department of the State jointly with the relevant departments of the State Council and the Central Military Commission and be submitted to the State Council and the Central Military Commission for approval.

Article 17 An arms trading company shall, before exporting arms, apply to the competent arms export department of the State for an arms export licence on the basis of the approval document for the contract of arms export; when the requirements are met for an arms export contract, the competent arms export department of the State shall issue the arms export licence within 10 days from the date of receipt of the application.

The Customs shall accept declarations according to the arms export licence, and examine and give clearance in accordance with the relevant provisions of the State.

Article 18 Measures for the examination and approval of proposals and contracts for arms export and methods for the issue of arms export licences shall be prescribed by the competent arms export department of the State.

Article 19 For arms export, the competent arms export department of the State shall issue a notice of arms export jointly with the departments concerned. Upon receiving the notice of arms export, the departments concerned and the local people's governments shall conscientiously perform their functions and responsibilities according to the relevant provisions of the State in order to ensure safe, speedy and accurate export of arms.

Chapter IV Order of Arms Export

Article 20 No unit or organization which has not obtained the business operations right for arms export shall engage in any arms export business activity.

The State forbids any individual to engage in any arms export business activity.

Article 21 Arms trading companies shall abide by the provisions of laws and administrative regulations and maintain the normal order of arms export in their arms export business activities.

Article 22 Arms trading companies shall not commit any of the following acts in their arms export business activities:

(1) impairing the security of the State or social and public interests;

(2) pushing out any other competitor by means of unfair competition;

(3) infringing upon the intellectual property rights protected by the laws of the People's Republic of China;

(4) forging, altering, obtaining by fraud or illegally transferring any document or certificate such as the approval document for arms export proposals, the approval document for a contract, the licence and the valid certification document of the recipient country;

(5) overstepping the approved scope of business; or

(6) any other act in violation of the provisions of laws and administrative regulations.

Article 23 The competent arms export department of the State may, when it deems necessary or at the request of an arms trading company, deal with any act which obstructs the normal order of arms export.

Chapter V Legal Liability

Article 24 Where any arms trading company violates the provisions of Article 11 of these Regulations, the competent arms export department of the State shall order it to make corrections within a specified time limit and give it a warning; if failing to make corrections within the specified time limit, such company shall be fined not less than 20,000 yuan but not more than 100,000 yuan and its business operations right for arms export shall be suspended or even revoked.

Article 25 Where any arms trading company violates the provisions of subparagraph (4) or (5) of Article 22 of these Regulations and also violates the criminal law, it shall be investigated for criminal liability in accordance with the provisions of the criminal law on the crime of illegal operation, the crime of forging, altering, buying or selling official documents, certificates or seals of a State organ or other crimes; if the case is not serious enough for criminal punishment, the competent arms export department of the State shall give it a warning, confiscate its illegal income and concurrently impose a fine of not less than one time but not more than three times the illegal income; if there is no illegal income or the illegal income is less than 100,000 yuan, a fine of not less than 100,000 yuan but not more than 300,000 yuan shall be imposed and its business operations right for arms export shall be suspended or even revoked.

Where any arms trading company violates the provisions of subparagraph (1), (2) or (3) of Article 22 of these Regulations or the provisions of laws or other administrative regulations, the competent arms export department of the State shall impose penalties on it in accordance with the provisions of relevant laws and administrative regulations and may concurrently suspend or even revoke its business operations right for arms export; if violating the criminal law, it shall be investigated for criminal liability in accordance with the relevant provisions of the criminal law.

Article 26 Any illegal activity in violation of the provisions of Article 20 of these Regulations shall be banned by the competent arms export department of the State; if such activity violates the criminal law, criminal liability shall be investigated in accordance with the provisions of the criminal law on the crime of illegal operation or other crimes; if the case is not serious enough for criminal punishment, the competent arms export department of the State shall give a warning, confiscate the illegal income and concurrently impose a fine of not less than one time but not more than five times the illegal income; if there is no illegal income or the illegal income is less than 100,000 yuan, a fine of not less than 100,000 yuan but not more than 500,000 yuan shall be imposed.

Article 27 Where an arms trading company refuses to accept a specific administrative act of the competent arms export department of the State, it shall apply for administrative reconsideration according to law at first; if it still refuses to accept the decision of administrative reconsideration, it may bring an administrative suit to the people's court according to law.

Article 28 Where any State functionary engaged in administration of arms export abuses his power, neglects his duty or accepts or extorts money or property from other persons by taking advantage of his office thereby violating the criminal law, he shall be investigated for criminal liability in accordance with the provisions of the criminal law on the crime of abuse of power, the crime of neglect of duty, the crime of acceptance of bribes or other crimes; if the case is not serious enough for criminal punishment, he shall be given an administrative sanction according to law.

Chapter VI Supplementary Provisions

Article 29 These Regulations shall be applicable to the export of police equipment.

Article 30 These Regulations shall come into force as of January 1, 1998.

Military Products Export Control List

Foreword

For the purpose of enhancing arms export control, streamlining the order of arms export, and pushing overall lawful administration, this list is made in accordance with the "Arms Export Regulations of the People's Republic of China".

Conventional classification is used in this list with 14 categories, including: small arms; artillery and other projectors; ammunition, land mines, sea mines, bombs, anti-tank missiles and other explosive devices; tanks, armored vehicles and other military vehicles; military engineering equipment; military ships and their special equipment; military aero vehicles and their special equipment; rockets, missiles, military satellites and their support equipment; military electronic products and fire control, range finder, optical, guidance and control equipment; powder and explosive, propellants, incendiary agents and related compounds; military training equipment; protective equipment against nuclear, biological and chemical weapons; logistic equipment, materials, and other support military equipment; and miscellaneous articles. Each category is further divided into several sub-categories, and explanations are given to related technical terms, thus a framework structure is formed with the main body of four levels of weapon definitions, weapon categories, main systems or components of weapons, and the parts and components, technologies and services directly related to the weapon equipment.

In conformity with the international commitment made by China, this list does not include nuclear weapon (or its key components, raw materials or technologies) or other articles banned for export.

In conformity with the second item of the "Arms Export Regulations of the People's Republic of China", this list is made, revised and published by the State arms export control authority.

The State arms export control authority is responsible for the explanation of this list.

Category 1 Small Arms

1.1 Small arms: arms carried and used by individual or squad, including:

1.1.1 Firearms: tubular type weapons mainly using the energies by the way of powder burning gas to launch bullet of cartridge through barrel, with the caliber below 20mm (0.78 inch), including pistol, submachine gun, rifle, machine gun, and other special purpose guns.

1.1.2 Grenade weapons: infantry close combat weapons to fulfill a certain combat task by launching grenade, including grenade-discharger, mortar-type grenade launcher, recoilless launcher, rocket launcher, grenade launcher, jet shot grenade launcher, individual guided weapons, grenades, and other types of grenade launchers.

1.1.3 Special equipment: weapons carried and used by individual or squad to fulfill the tasks of demolition, mine laying, mine detecting, mine clearing, setting on fire, setting on smoke, illumining, signaling, anti-riot action, and other special tasks.

1.1.4 Light-weight laser jamming devices.

1.1.5 Cold weapons, including bayonet, multi-purpose knife, paratrooper knife, pilot knife, and other military knives.

1.2 Sighting devices, night sighting devices, mufflers, restrainers, and flash restrainers associated with all articles enumerated in paragraph 1.1 of this category.

1.3 Parts, components, accessories, attachments, fittings, spare parts, semi-finished products, and samples associated with all articles enumerated in paragraphs 1.1 through 1.2 of this category.

1.4 Technology, manufacturing techniques, equipment, technical documents (including software), services, special raw materials and auxiliary materials directly related to the development, production, test, measurement, inspection, application, maintenance, upgrading and modification of all articles enumerated in paragraphs from 1.1 through 1.3 of this category.

Category 2 Artillery and Other Projectors

2.1 Artillery: tubular type shooting weapons using the energies by the way of powder burning gas to launch shells, with the caliber equal to or bigger than 20mm (0.78 inch), including cannons, howitzers, mortars, howtars, rocket launchers, recoilless guns, anti-aircraft guns, tank guns, anti-tank guns, aircraft guns, shipboard guns, coast guns, and the self-propelled forms and APU of the above artilleries,

2.2 Artilleries of various new energies.

2.3 Sighting devices, night sighting devices, range finders, launch mounts and base associated with all articles enumerated in paragraphs 2.1 through 2.2 of this category.

2.4 Military flame thrower and its associated components and devices, including oil storage devices, pressure source devices, oil pipe, igniters, and throwing devices.

2.5 Parts, components, accessories, attachments, fittings, spare parts, semi-finished products, and samples associated with all articles enumerated in paragraphs 2.1 through 2.4 of this category.

2.6 Technology, manufacturing techniques, equipment, technical documents (including software), services, special raw materials and auxiliary materials directly related to the development, production, test, measurement, inspection, application, maintenance, upgrading and modification of all articles enumerated in paragraphs from 2.1 through 2.5 of this category.

Category 3 Ammunition, Land Mines, Sea Mines, Bombs,

Anti-Tank Missiles and Other Explosive Devices

3.1 Ammunition: the generic name of the devices and parts and components to use powder burning gas pressure or other energies to throw shots and accessories by using firearms, individual or squad combat launching devices, and various types of tubular weapons and launching mounts (tubes), including:

3.1.1 Cartridges, gun ammunitions, rockets, grenades and other ammunition of various calibers equipped for all weapons of Categories 1 and 2 in this list.

3.1.2 The projectile (including fuse, shell body, and filler), propelling charge (including gun propellant and its attachments, cartridge case or charge bags, and igniters), core, booster explosive, initiator, primer, safety and safety release devices, and the once-operation high output power associated with all articles enumerated in paragraph 3.1.1 of 3.1 in this category.

3.1.3 Ammunition belt and linking machinery.

3.2 Ammunition manufacturing machinery and ammunition loading machinery.

3.3 Land mine: weapons to be laid under or above land surface as explosive barriers to be triggered by targets' action (or by operators), including:

3.3.1 Anti-tank mines, anti-personnel mines, and special mines.

3.3.2 Mine body and fuse.

3.4 Sea mine: Explosive devices to be laid in close shore shallow sea water, or in river or lake to damage or delay ships, amphibious vehicles and personnel, including:

3.4.1 River mines, beach mines, and special mines.

3.4.2 Mine body, fuse, charge, initiator, auxiliary instrument, mine-laying attachments, depth setting and holding devices and related components of mines.

3.5 Bomb: ammunition and their dispensers to be released by aircraft or other aero vehicles, including charge shell body, stabilizing devices, fuse, explosion enhancing devices, hanging lug, and the attached speed reducing devices, guidance devices and power systems required per application.

3.6 Anti-tank missile: missiles to be used to attack tanks or other armored targets, defense works, or shelters (including remote control guidance or homing guidance devices of anti-tank missiles).

3.7 The launching devices, demolition devices, initiator, flashback devices, detonators, sighting devices, night vision devices, and various equipment equipped for all articles enumerated in paragraphs 3.1 through 3.6 of this category.

3.8 The handling, controlling, initiating, monitoring, inspecting, and dismounting devices, and software, equipment and apparatus associated with all articles enumerated in paragraphs 3.1 through 3.7 of this category.

3.9 Destroying and eliminating equipment of military explosives.

3.10 Burning resistant materials processed or semi-processed with advanced composite materials (such as silicon, graphite, and carbon/boron fibers) and specially designed or modified for all articles in this category.

3.11 Parts, components, support parts, accessories, attachments fittings, spare parts, semi-finished products, and samples associated with all articles enumerated in paragraphs 3.1 through 3.9 of this category.

3.12 Technology, manufacturing techniques, equipment, technical documents (including software), services, special raw materials and auxiliary materials directly related to the development, production, test, measurement, inspection, application, maintenance, upgrading and modification of all articles enumerated in paragraphs from 3.1 through 3.11 of this category.

Category 4 Tanks, Armored Vehicles and Other

Military Vehicles

4.1 Tank: tracked armored fighting vehicles with strong straight fire, high off-road maneuverability and strong armor protection, including main battle tanks, amphibious tanks, reconnaissance tanks, and airborne tanks.

4.2 Armored vehicle: various types of tracked or wheeled military vehicles with armor protection, including amphibious armored vehicles, armored infantry fighting vehicles, armored personnel carriers, armored reconnaissance vehicles, armored command vehicles, armored communication vehicles, armored electronic-countermeasure vehicles, armored intelligence processing vehicles, armored ambulance vehicles, armored decontamination vehicles, armored ammunition supply vehicles, armored supply vehicles, and armored security vehicles.

4.3 Other military vehicles: all tracked or wheeled vehicles for military applications (military engineering vehicles and logistic support vehicles are not included in this category), including special assault vehicles, various types of rocket and missile launching vehicles, chassis vehicles for self-propelled artillery, fighting support vehicles, high-maneuverability multi-purpose wheeled vehicles (including reconnaissance vehicles and security vehicles), and other special military vehicles.

4.4 The chassis, power and transmission devices specially designed or modified for all articles enumerated in paragraphs 4.1 through 4.3 of this category.

4.5 The active armor and reactive armor devices equipped for articles enumerated in paragraphs 4.1 through 4.2 of this category.

4.6 Parts, components, accessories, attachments, fittings, spare parts, semi-finished products, and samples associated with all articles enumerated in paragraphs 4.1 through 4.5 of this category.

4.7 Technology, manufacturing techniques, equipment, technical documents (including software), services, special raw materials and auxiliary materials directly related to the development, production, test, measurement, inspection, application, maintenance, upgrading and modification of all articles enumerated in paragraphs from 4.1 through 4.6 of this category.

Category 5 Military Engineering Equipment

5.1 Military engineering equipment: equipment used for military actions of engineering construction, bridge construction, floating crossing, wading crossing, mine laying, mine detecting, mine sweeping, mine clearing, rescue, recovery, demolition, obstacle-clearing, and concealment, including:

5.1.1 Vehicles and equipment for military engineering construction, including bulldozer, loader, digger, road smoother, road press, and military engineering machinery, equipment, materials and tools.

5.1.2 Engineering, rescue and recovery vehicles, including tank recovery vehicles, armored maintenance and recovery vehicles, armored servicing engineering vehicles, tank bridgelayers, road equipment (including road vehicles), floating crossing equipment, boat bridge, military bridges (including mechanical bridge and landing stage), floating pier, and wading crossing equipment (including light wading equipment).

5.1.3 Equipment, materials and vehicles for mine laying, mine detecting, mine sweeping, and mine clearing, including mine-clearing tanks, road mine clearing vehicles, armored mine -clearing vehicles, armored mine laying vehicles, towed mine layers, mine-scattering vehicles, rocket mine laying vehicles, rocket mine clearing vehicles, mine clearing rockets, man-packed mine laying systems, electronic mine detection materiel, metallic mine detectors, non-metallic mine detectors, aerial bomb detectors, demolition rockets, soft demolition device, primacord net, mine clearing roller, and mine clearing plough and mine clearing chain.

5.1.4 obstacle-clearing equipment, including obstacle-clearing vehicles, anti-infantry obstacle-clearing systems, and landing obstacle-clearing systems.

5.1.5 Engineering demolition equipment, including rocket demolition kits, foxhole exploders, bangalore torpedo, unified explosive block, explosive initiators, and remote-control priming devices.

5.1.6 Testing and inspection apparatus.

5.1.7 Camouflage and cheating equipment, including decoy, simulation devices, and smoke, camouflage and covering devices.

5.2 Parts, components, accessories, attachments, fittings, spare parts, semi-finished products, and samples associated with all articles enumerated in paragraph 5.1 of this category.

5.3 Technology, manufacturing techniques, equipment, technical documents (including software), services, special raw materials and auxiliary materials directly related to the development, production, test, measurement, inspection, application, maintenance, upgrading and modification of all articles enumerated in paragraphs from 5.1 through 5.2 of this category.

Category 6 Military Ships and Their Special Equipment

6.1 Military ship: ships designed, built, upgraded, modified, or equipped for military purpose and able to navigate at water surface, in ground effect wing area or under water surface, including:

6.1.1 War ships (including those powered by nuclear energy), including destroyer, escort vessel, escort boat, missile boat, torpedo boat, sub-chaser, submarine, amphibious war ship, landing ship, patrol boat (including river and lake patrol boat), assault boat, military hovercraft, mine laying ship, anti-water mine ship, mine hunting and sweeping ship, and other special war ships.

6.1.2 Military auxiliary ships, including submarine support and rescue ship, marine supplies ship, medical service ship, supplies/repair ship, reconnaissance ship, battle support logistic ship, non-battle support and service ship, and other special operational ships for military purposes.

6.2 Shipboard weapon systems: weapon systems and their equipment specially designed or modified to give combat ability to war ships, taken the military ship or carrier-based aero vehicle as the platform, and provided with the functions from target finding to firing control They include the battle command and control system, ship machine gun, ship artillery, rocket gun, torpedo, water mine, missile, depth bomb, anti-submarine warfare device, firing control device, and various types of mine hunting, sweeping and clearing devices.

6.3 Special equipment for ships: special system or equipment specially designed or modified for war ships, including:

6.3.1 Ship power, propelling and control equipment, including nuclear power, diesel engine, gas turbine, steam turbine, electric propelling system, and power battery, electric generator, propelling motor, as well as various types of propeller and rear transmission device.

6.3.2 Ship navigation system and equipment, including integrated navigation display and control console, inertial navigation system, platform compass, satellite navigation receiving equipment, electronic compass, magnetic compass, electronic sea chart, radio navigation system, log, depth-sounder, and diving meter.

6.3.3 Other special equipment and devices for ships, including helicopter touch-down system and equipment, ship-board unmanned aero vehicle launching and recovering equipment, swing absorber, ship operation system and rudder, diving and floating control console, air compressor, high-pressure air bottle, pressure storage vessel, various types of pumps, anchor device, cabin air environment control system and equipment, special propellers, various types of protection and rescue equipment and submarine support and rescue equipment.

6.4 Shipboard electronic and optic equipment, including C4ISR (command, control, communication, computer, intelligence, surveillance, reconnaissance) system for naval operational application, various types of radar, electronic warfare, electronic reconnaissance, electronic jamming, and electro-magnetic environment simulators, various types of sonar and system display and control console, home ship noise inspector, acoustic target simulator, and communication system and equipment, various types of antenna, electro-optic tracing instrument, electronic countermeasure system and equipment, diving periscope and associated device, water-acoustic countermeasure system and firing control equipment, various types of water-acoustic jamming device, smoke shell and decoy, infrared night vision sight, laser range finder, under-water target detecting and tracing device (including acoustic, magnetic, and water pressure detecting and tracing equipment).

6.5 Parts, components, accessories, attachments, fittings, spare parts, semi-finished products, and samples associated with all articles enumerated in paragraphs from 6.1 through 6.4 of this category.

6.6 Technology, manufacturing techniques, equipment, related production lines, technical documents (including software), services, special raw materials and auxiliary materials directly related to the development, production, test, measurement, inspection, application, maintenance, upgrading and modification of all articles enumerated in paragraphs from 6.1 through 6.5 of this category.

Category 7 Military Aero Vehicles and Their

Special Materiel and Equipment

7.1 Military aero vehicle: aero vehicles specially designed, modified or equipped for military purposes, including fighter (interceptor), bomber, fighter-bomber, attacker, reconnaissance aircraft, early-warning aircraft, electronic warfare aircraft, tanker aircraft, shipboard aircraft, seaplane, transport aircraft, all-purpose aircraft, ultra-light aircraft, training aircraft, demonstration aircraft, ground-effect wing aero vehicle, hovercraft, special manned aero vehicle, balloon, airship, armed helicopter, reconnaissance helicopter, communication and command helicopter, shipboard helicopter, transport helicopter, multi-purpose helicopter, training helicopter, electronic countermeasure helicopter, unmanned helicopter, reconnaissance unmanned aero vehicle, electronic countermeasure unmanned aero vehicle, unmanned attack aero vehicle, target aero vehicle, unmanned airship, and the associated control and inspection equipment, special parachute and helmet for paratroops, helmet and life saving equipment (including life-saving parachute, ejection seat, and other survival kit) for military aero vehicle pilots.

7.2 Military aircraft engine: engines specially designed or modified for the military aero vehicles of item 7.1 of this category, including piston engine, turboprop engine, turboshaft engine, turbojet engine, turbofan engine, ram jet engine (including air inlet), solid rocket engine, liquid rocket engine, and the associated equipment for the above-mentioned engines.
