In order to ensure in their countries an adequate protection against animal diseases and those caused by animal origin products, characterised by the inappropriate health;
To reduce the risk of infectious and/or contagious and parasitic diseases;
Guided by the desire to further develop the relations between the two countries, to facilitate the trade in live animals, animal genetic material (semen for artificial insemination, embryos, eggs for reproduction), animal origin products, animal raw materials, drugs and the other products for use in veterinary medicine, animal feed and feed raw materials, and also other goods which can influence animal health.
Have decided to conclude the following:
The Contracting Parties shall cooperate for the protection of their national territories against the transmission of epizootic diseases during the imports, exports and transits of live animals, animal genetic material (semen for artificial insemination, embryos, eggs for reproduction), animal origin products, animal raw materials, drugs and the other products for use in veterinary medicine, animal feed and feed raw materials and also other goods, which can influence animal health, transportation means, packs and containers which could possibly be pathogen vectors.
Each Contracting Party shall respectively authorize its veterinary competent authority to implement this Convention and establish direct contacts to solve all the problems related to the sanitary veterinary, animal quarantine and health, in accordance with this Convention.
The competent veterinary authorities of each Contracting Party in applying this Convention are the following:
1. The Administration of Animal and Plant Quarantine of Ministry of Agriculture of the People's Republic of China.
2. The National Sanitary Veterinary Agency from the Ministry of Agriculture and Food of Romania.
The import, export or transit of live animals, animal genetic material (semen for artificial insemination, embryos, eggs for reproduction), animal origin products, animal raw materials, drugs and the other products for use in veterinary medicine, animal feed, feed raw materials and also other goods which can influence animal health, submitted for control by animal quarantine at border or sanitary-veterinary authority from the national territory of one Contracting Party to the national territory of the other Contracting Party, should comply with the relevant quarantine protocols, meet the quarantine and health requirements of the importing country and must be accompanied by a quarantine or health certificate, issued by the competent veterinary authority of the exporting country.
The Contracting Parties shall exchange specimen of certificates defining the conditions for import, export or transit of live animals, animal genetic material (semen for artificial insemination, embryos, eggs for reproduction), animal origin products, animal raw materials, drugs and the other products for use in veterinary medicine, animal feed, feed raw materials and also other goods which can influence animal health, and shall inform each other in proper time about the amendments and additions introduced in these documents.
1. The competent veterinary authorities of each Contracting Party have the following obligations:
a) to inform each other, immediately, about the diseases mentioned in list"A"of the International Office of Epizootics (OIE) which are breaking out on its national territory, specifying the animal species, number of affected animals, places and their spreading risk areas where the disease have been reported, diagnostic methods and the measures which have been taken to control the disease and to prevent its spreading on their national territory;
b) to exchange monthly official veterinary bulletins indicating the statistics of the transmissible diseases of animals mentioned in the list "A" and list "B" of OIE.
2. The competent veterinary authorities of each Contracting Party will inform immediately each other on the protection measures taken to avoid the transmission of the diseases mentioned in list "A" of OIE in case that these transmissible diseases have been reported in a neighbouring state.
3. Upon the request of one Contracting Party and the other Contracting Party considers that is necessary and agrees, the asking party may send veterinarians to collaborate with the competent veterinary authorities of the exporting country in inspection of export of live animals, animal genetic material (semen for artificial insemination, embryos, eggs for reproduction), animal origin products, animal raw materials, drugs and the other products for use in veterinary medicine, animal feed, feed raw materials and also other goods which can influence animal health.
The Contracting Parties will facilitate the cooperation between the competent veterinary authorities on administration, legal provisions, research and academic exchange in the sanitary veterinary field, animal quarantine and health, by way of:
a) exchange of experience and knowledge concerning the issues of the veterinary profession;
b) cooperation between the competent veterinary authorities, the specialized institutions and laboratories;
c) exchange of experience and knowledge on management of animal genetic resources and date regarding animal biotechnology;
d) exchange of information and working visits of veterinary specialists and scientific staff.
The expenses by applying provisions of the present Convention shall be borne by each Contracting Party respecting its domestic legislation.
1. The representatives of the competent sanitary veterinary authorities of the Contracting Parties shall meet whenever is necessary at place and time mutually agreed on.
2. Any disputes concerning the interpretation or carrying out of the present Convention shall be solved through direct negotiations between the Contracting Parties.
3.In case no understanding is reached during the negotiations mentioned under item 2 of this Article, the discrepancies between the Contracting Parties as to the implementation of the present Convention shall be examined by a Joint Commission. The commission shall be composed of two official veterinarians and one lawyer from each Contracting Party.
The commission shall meet on the request of one of the Contracting Parties within 30 days from the date of asking for such a meeting by one of the Contracting Parties, on the territory of its state. The meeting will be chaired alternately by one member of each delegation.
The present Convention does not affect the rights and obligations of the Contracting Parties, resulting from other international agreements, concluded by each Contracting Party in the sanitary veterinary field, animal quarantine and health.
This Convention shall come into force sixty days from the date of the last notification through which the Contracting Parties shall notify each other about the fulfillment of procedures required by their national legislation necessary for its approval.
The present Convention is concluded for a period of five years. This period shall be automatically extended for new periods of five years, unless one of the Contracting Parties notifies the other Contracting Party at least six months before the expiration of the validity of the respective period, about its intention to denounce this Convention.
On the date this Convention between the Government of the People's Republic of China and the Government of Romania comes into force, the Veterinary Sanitary Agreement between the Government of Socialist Republic of Romania and the Government of the People's Republic of China regarding technical cooperation in the field of animal disease control, which came into force on December 9, 1978, ceases its validity.
Signed in Beijing on September 8, 1997, in two original versions, each in the Chinese, Romanian and English language, all texts being equally authentic. In case of divergencies of interpretation, the English text will prevail.
